With year one of the Biden Administration’s term in the history books, we have a clearer sense of how the U.S. Environmental Protection Agency (EPA) is proceeding on all fronts. EPA’s Office of Pesticide Programs (OPP) focuses on long-standing challenges, especially a renewed effort to meet Endangered Species Act (ESA) consultation requirements and determine how best to meet core pesticide registration review obligations in 2022. These program priorities must reflect special considerations for environmental justice and climate change, advance critical science and policy issues, develop a fifth Pesticide Registration Improvement Act (PRIA) implementation framework, and display a renewed commitment to working collaboratively with state partners and other stakeholders to implement the program.

(B&C®) was pleased to present “Navigating the Jurisdictional Tightrope Between Biopesticides, Biostimulants, and Related Emerging Technologies” deconstructing the jurisdictional boundaries distinguishing pesticides, biopesticides, plant regulators, biostimulants, and related technologies. The webinar focused on draft EPA guidance intended to clarify the lines between and among those products that are subject to FIFRA registration as plant regulators and those biostimulant products not subject to FIFRA registration. The webinar also focused on new and evolving chemistry and technology issues that may blur some jurisdictional lines or potentially move products from one category to another. Lynn L. The IBA Agricultural Law Section, supported by the ABA Section of Environment Energy and Resources, Committee on Pesticides, Chemical Regulation and Right-to-Know, the Environmental Law Institute and the National Agricultural Law Center, presented “Sustainable Investment in Agriculture,” with a focus on emerging legal issues in the area of sustainable and responsible investment in agriculture. Presenters discussed emerging tools and legal models for ensuring sustainable investment in agriculture, with a focus on the UNIDROIT initiative; due diligence for proposed investments; financial instruments; and where we go from here.
